SEA LIFE CRUISES
These Terms & Conditions govern all bookings, tickets, charters, and services provided by Sea Life Cruises (hereinafter referred to as “the Company”, “we”, “us”, or “our”).
By booking a trip, purchasing a ticket, or participating in any service provided by Sea Life Cruises, you agree to be bound by these Terms & Conditions.
Section 1 – Services
Sea Life Cruises operates boat trips, excursions, and private charters in Malta, Comino, Gozo, and surrounding waters.
All routes, stops, departure points, and return locations are subject to change due to weather conditions, safety considerations, sea conditions, operational requirements, or other legitimate reasons.
The skipper has full authority at all times. All passengers must follow crew instructions promptly and without delay.
The Company reserves the right to refuse boarding or terminate a trip where necessary for safety, security, operational, or behavioural reasons.
Section 2 – Booking & Payment
2.1 General Bookings (Half Day Trips)
A booking is confirmed only upon receipt of full payment.
Tickets are personal and non-transferable unless otherwise agreed in writing.
2.2 Private Charters
Full payment is required in advance to confirm a private charter booking.
A private charter is not considered confirmed until full payment has been received.
Any applicable fuel fee shall be payable onboard on the day of the charter, unless otherwise agreed in writing.
Failure to settle outstanding onboard fees may result in termination of the charter without refund.
Section 3 – Cancellation, Refund & Rescheduling
3.1 Half Day Trips
Cancellations made at least 24 hours prior to the scheduled departure time are eligible for a full refund.
Cancellations made less than 24 hours before departure time are non-refundable.
Rescheduling is permitted without charge if requested at least 24 hours prior to departure and is subject to availability.
Refunds will be processed within 7–10 business days to the original method of payment.
3.2 Private Charters
Private charters may be cancelled or rescheduled without penalty provided written notice is received at least 24 hours prior to the scheduled departure time.
Cancellations made less than 24 hours before departure are non-refundable.
Rescheduling requests made less than 24 hours prior to departure may be refused and are subject to availability.
3.3 Weather & Operational Cancellations
If the Company cancels a trip due to adverse weather, safety concerns, mechanical issues, or other unforeseen operational circumstances:
Customers will be offered either a full refund or the opportunity to reschedule.
The Company shall not be liable for any additional costs incurred by the customer, including travel or accommodation expenses.
Section 4 – Late Arrival & No-Show
Passengers must arrive at least 15 minutes prior to departure.
The vessel will depart strictly at the scheduled time.
Late arrivals who miss departure are not entitled to a refund or rescheduling.
Customers who fail to attend without prior notice will be classified as no-shows and are not entitled to a refund or rescheduling.
Private Charters
Late arrival for a private charter will not result in a refund or extension of the agreed charter duration.
Section 5 – Passenger Conduct
Passengers must comply with all instructions given by the skipper and crew.
The Company reserves the right to deny boarding or terminate a trip without refund in cases of:
- Misconduct
- Unsafe or disruptive behaviour
- Excessive intoxication
- Drug use
- Failure to follow safety instructions
- Alcohol consumption by persons under the age of 18 is strictly prohibited. Valid identification may be requested.
- Passengers are responsible for their personal belongings at all times.
Section 6 – Safety & Assumption of Risk
- Participation in marine activities involves inherent risks.
- All passengers participate at their own risk.
- The Company shall not be liable for:
- Loss or damage to personal property
- Personal injury unless caused by proven gross negligence or wilful misconduct of the Company
4. Where liability is legally established, it shall be limited to the amount paid for the booking in question.
Section 7 – Children
Children remain under the full responsibility of their parent or legal guardian at all times.
Life jackets are available upon request.
Section 8 – Force Majeure
The Company shall not be liable for any failure or delay in performance resulting from events beyond its reasonable control, including but not limited to:
Severe weather conditions
Government restrictions
Natural disasters
Mechanical breakdowns
Maritime authority restrictions
In such cases, customers may be offered rescheduling or a refund at the Company’s discretion, without entitlement to additional compensation.
Section 9 – Liability
The Company is not liable for damage to or loss of passenger property.
Boarding and disembarking from vessels, jetties, or quays is undertaken at the passenger’s own risk.
The passenger is liable for any damage caused to the vessel, crew, equipment, or third parties due to their actions.
Section 10 – Complaints
Any complaint must be raised immediately with the crew to allow an opportunity for resolution.
If unresolved, complaints must be submitted in writing within 20 days from the date of the trip.
Failure to notify the Company within this period may result in loss of the right to claim.
Section 11 – Governing Law & Jurisdiction
These Terms & Conditions are governed by the laws of Malta.
Any disputes arising shall be subject to the exclusive jurisdiction of the Maltese Courts.
Nothing in these Terms limits rights granted under Maltese or European Union consumer protection law.
Section 12 – Amendments
Sea Life Cruises reserves the right to update or amend these Terms & Conditions at any time. Updated versions become effective immediately upon publication.
